1. Introduction
a) This user agreement (the "Agreement"), that includes the terms & conditions set out below and those incorporated by reference including the terms of the Game rules and Privacy Policy is an agreement between you ( "User", “Player” "you" and "your" ), and Winner Games Private Limited and our licensors, associates, affiliates and partners (the "our", "us", "we" and “company”) which governs your use of the products and services ("Services") provided by Winner Games Private Limited through the www.Deccanrummy.online website (the "Site") and associated software and Deccan Rummy mobile application ("Application") on player’s computers, tablets or smartphones (the “Device”). By using any of the Services you are agreeing to all the terms of this Agreement.
b) Even if some of the terms are found to be invalid, void or unratified for any reason by any judicial body within India, you must make note that they will not affect the existence and implementation of the remaining Terms. Any failure or delay on our part to act or exercise any right or remedy with respect to a breach of any of the terms of as mentioned by you shall not be construed as a waiver of our right to act with respect to any breaches.
2. Agreement
a) You must use our service only after you read, understand and agree to all the terms and conditions mentioned in the agreement. You must abide by terms & conditions mentioned here. If you have any questions about the Agreement please contact us at support@deccanrummy.online.
b) Deccan Rummy reserves the right to amend, alter or modify (including the game rules) the Terms any time without giving any prior notice to the players. We may notify of some of the changes in the Terms either by sending an email or by displaying a message on the Website. Such modifications could include changes to any of our Game Rules. Continued usage of our services would be deemed as the acceptance to any of the above said changes. In the event you do not agree with the amendments, you may terminate the use of our Services by notifying us that you wish to terminate your Account.
3. Ownership
Ownership of the Deccanrummy.online name and any of the other names or marks associated with the Site, the Services or the Application is strictly forbidden, unless it is used with the explicit written permission by us. The WebSite, games, Mobile Application, including its code (including modification), documentation, appearance, structure, and organization are an exclusive product of the Company, which retains all rights, tangible and intangible, to the Deccan Rummy.
4. Eligibility
a) To access our services, a User must register for a user account ("Account"), and veraciously provide all the mandatory details.
b) You must be at least 18 years old to participate in our games. Practice Games can be defined as games that are played with virtual game chips called “Play Chips”.
c) The Player must be fully aware of the fact that by viewing or using the Website or availing of any Services, or using communication features on our Website you may come across content posted by other users which you may consider offensive, objectionable or insensitive. The player can bring such issues to our attention. We might take action on such issues if we deem your complaint as valid. The decision we take on these issues shall be final and binding on the player
5. Description of Services
All the registered users will get an opportunity to play online games of skill. The Play chips used in our application is only for entertainment and competing purposes, they do not carry any monetary values.
6. Your Account
a) Players are allowed to have only one account that should be used solely by them. Players must undertake that they provide authentic information at the time of opening the account and any notify us in-case you make any changes to it.
b) You must refrain from using the Services by means of an Account registered in name of other individuals.
c) We shall be entitled to close your account and ban you permanently should we find that you are attempting to open multiple accounts by any means.
d) Details like account name, password must be kept in secret and you must not share with any one at any cost. We will not be held responsible if someone else is accessing your account by using your login credentials.
7. Prohiibitions
7.1 You are prohibited from:
a. Posting any content that might be considered defamatory, obscene, invasive of privacy, abusive, libellous, intimidating, illegal, harassing or prejudicial to our Company, or can be considered as otherwise offensive without being illegal.
b. Activities that may be harmful to other Users or interfere with the functioning of the Site, application that includes not limited to attempting to decompile the Application, intercept communications with the Site, attempting to mask or spoof your IP address, or uploading contents that contain malware, viruses or any computer contaminants (as defined in the Information Technology Act 2000 or such other laws in force in India at the relevant time) that might interrupt, destroy, limit the functionality or disrupt any hardware, software or other equipments belonging to us or that aids in providing the services offered by us.
8. Game Rules
You agree that you will read and abide by the rules and regulations of each of the Games as published and updated. We may even add new games from time to time and the same agreement will become applicable to those added games. But we will notify you about the game rules of the new game that was added and will provide you an opportunity to read the game rules related to it.
9. System Failures
In the event of a server crash, software defect or any failure attributable to the Company, issues such as natural disaster or any other calamity, games would be cancelled and Deccan Rummy shall not be held liable for your play chip losses for such unfinished games.
10. Intellectual Property
All the games hosted, materials provided for reference, All rights, tangible and intangible in regards to the site and application belong exclusively to the company
Players can access information, download and print extracts from our Websites only for their personal uses. They must remember that no right, title or interest in the downloaded materials or software are transferred to them just by downloading and players are strictly prohibited from using such materials for any commercial purposes unless a deal is made with us in writing.
Players must acknowledge that all ownership rights and all copyrighted and other intellectual property rights in our Content are owned by DeccanRummy or our licensors and they have no right to title or other interest in any items except as explicitly stated in our Terms.
Company retains the right to content that are generated by users, including but not limited to the contents of chat messages, you must acknowledge that the Company shall not be held responsible for any User-generated Content. You are accessing the content at your own risk and company shall not be held liable if you come across obscene, defamatory, offensive user generated content that were accessible.
11. Breach and Consequences
a) You must acknowledge that if the company finds you in breach of the mentioned terms of the agreement (company has complete discretion in identifying the breach) and feels that your continued access will be detrimental to our interests then the company may take following action;
1. Suspend or delete your Account
2. Ban you completely from using or accessing the Services in the future
3. Impose restrictions upon your ability to play certain types of Games,
4. Report any suspicious or potentially illegal activity to legal or government authorities.
b) Any actions as mentioned above that may be taken by the Company would be without prejudice to any other legal or equitable rights available to our Company.
12. Limitation of Liability and Indemnity
a) DeccanRummy could not be held liable for any loss of profit or loss of opportunity, loss of data, injury, loss of chips, claim, loss of or damage to property, any general damages or any direct, indirect, incidental, consequential, exemplary, special or punitive damages of any kind that may arise out of or in connection with your access or inability to access or use, the Services on our Website
b) You agree to indemnify and hold harmless the Company against any suits, damages, penalties, claims, actions, or awards brought against us by one in connection with your use of our services in our site and applications.
13. Disclaimer
We do not ensure or guarantee continuous, error-free, secure or virus-free operation of our website or its Content including software, Games, user accounts, the transactions made in the user accounts or continuous operation or availability of any facility on our website.
DeccanRummy specifically disclaims any liability with respect to the cancellation or denial of Games or events organized on the website which may require specific statutory permissions.
DeccanRummy disclaims any responsibility and liability for any harm resulting from the cancellation of any Game organized by it. Players must acknowledge and agree that they will not be entitled to any refund in case of any service outage that could be caused by failures of our service providers, malware, virus or any contaminants, war, civil disturbance, natural disasters or any other cause beyond our control
DeccanRummy disclaims any liability in connection with the transactions the players could make with third parties that may have advertisements or are hyperlinked on our Website.
DeccanRummy is not liable for any potential winnings for unfinished games.
DeccanRummy specifically disclaims any liability that might arise because of the acts or omissions of the infrastructure providers or failure of internet services used for providing and accessing our Services.
DeccanRummy disclaims any responsibility in connection with the violation of intellectual property rights of any party with respect to third party Content or user content posted on our Website.
14. Warranty
a) The Company makes no warranty about the accuracy or completeness of the content made available on the Site, the Services or the Application.
b) The Company disclaims all warranties, express and implied with regards to non-infringement, freedom from computer virus of the Site, the Services or the Application. The Company does not represent or warrant that the functions in site/applications will remain uninterrupted or error-free, that defects will be corrected, or that they or the server that makes the Site, the Services or the Application available are free of viruses, malware or any other harmful portions.
c) We reserve the right to limit your use of our services or restrict you from participating in certain games or even terminate your account if we deem that you have caused any disruption/alteration of service
15. Use of Services
a) Our games have been created only for entertainment purposes, commercial use of services, site or application is forbidden. Players must use them only for playing games not for any other purposes.
b) We reserve to right to monitor your efforts in establishing multiple accounts. If we find that you have opened more than one account, all such accounts would be closed without any notice and we may even terminate your account permanently should you persist with this continued violation.
c) You must not host, intercept, emulate or redirect proprietary communication protocols, used by our Website, if any, regardless of the method used, including protocol emulation, reverse engineering or modification of the Website or any files that are part of the Website. Usage of robots, bots, cheats, “EPA programs” are strictly forbidden. Deccan Rummy might take steps to detect and prevent the use of EPA Programs, robots/ bots, or any form of artificial intelligence.
16. Third Party Sites
Our websites may have hyperlinks that link to third parties. We do not hold responsibility for the information in the website nor do we endorse the content published on the third party websites. Users are advised to access those websites at their own risk. DeccanRummy cannot be held accountable for such issues.
Any visit to a third party website through a hyper link here means, you are subjected to terms and conditions framed by those websites. The fact that such a link exists in our website does not equate that we endorse that website and its contents.
17. Governance & Jurisdiction
The Terms and Privacy Policy must be interpreted in tune with the laws of India.
Disputes, controversy or claims arising out of the Terms or Privacy Policy would be subject to the exclusive jurisdiction of civil courts in Chennai, Tamil Nadu.
18. Disconnections
a) Other than the crash of company server, Deccan Rummy will not be responsible for the internet disconnection or any communication failures that might happen at the user’s end.
b) However, players will remain on the table in case of disconnection and would be able to continue to play the game once the connection is up as we are aware of the connectivity disruptions that often happen in our country.

20. Accepting the terms & conditions

In the event you wish to terminate your Account, write to us at support@deccanrummy.online with reasons to terminate.
